Terms and privacy.
Here, in plain language, are the terms I work under and how I look after the information and images of the people who hire me. If anything is unclear, write to me and we'll talk it through. (English translation for reference; the Spanish version prevails.)
Terms and conditions
1. Scope
These terms apply to the wedding photography and content services and to the video services (directing, cinematography, editing, color grading and motion graphics) provided by Kevin Bahamondez, based in Buenos Aires, Argentina (hereinafter “the photographer”). By booking a date or approving a quote, the client accepts these terms together with the specific quote or contract. In case of any discrepancy, the signed specific contract prevails.
2. Booking and payment
- The date is only reserved upon payment of a 30% deposit of the total price. Until then, the date may be taken by another couple or client.
- The remaining 70% is paid on the day of the event, unless otherwise agreed in writing.
- Prices published on the site are for reference and may be updated. The price stated in an accepted quote is honored for as long as the quote is valid.
- The travel and transport costs outside the usual working area are paid by the client and agreed before signing, depending on distance and venue.
3. Date changes and cancellations
- If the client needs to change the date, we will try to reschedule at no cost, subject to availability. The deposit is applied to the new date.
- If the client cancels the service, the deposit is non-refundable, since the date was blocked and other work was turned down.
- If the photographer is unable to attend due to force majeure (illness, accident or another unforeseeable event), a replacement of equivalent professional level will be offered or, if the client prefers, a full refund of the amount paid.
4. The day of the event
- Coverage follows the timing of the package booked. Extra hours are quoted separately and are subject to availability.
- The client agrees to share the schedule, the locations and any venue restrictions (for example, no flash during religious ceremonies).
- For long events, a place to rest and a meal for the team are requested.
- The working style is documentary and natural: a photo of every guest or every moment is not guaranteed, although all the key moments agreed upon will be covered.
5. Deliveries and file storage
- Same day: 10 to 15 edited photos to share on social media.
- Full package: also a high-quality printed album of selected photos and the complete gallery on a USB drive, delivered together with the final delivery.
- Final delivery: the complete edited gallery is delivered up to 60 days after the event, in digital format.
- The selection and editing of the images are part of the photographer's style. Unedited (RAW) files are not delivered unless agreed in advance.
- The original files are kept as a backup for up to 1 year after the event. After that period their availability is not guaranteed, so we recommend downloading and backing up the files as soon as you receive them.
6. Copyright and image use
- Under Argentine Intellectual Property Law 11.723, the photographer retains authorship of the images and videos.
- The client receives a personal use license: they may print them, share them on social media and give them to family, crediting the photographer whenever possible. They may not sell them or use them commercially without permission.
- The photographer may use a selection of images in their portfolio, website and social media. If the client does not wish them to be published, it is enough to say so in writing before or after the event, and this will be respected (article 53 of the Argentine Civil and Commercial Code).
- Applying filters to or re-editing the delivered photos and publishing them credited to the photographer as author of that version is not allowed.
7. Video projects for brands
- Each project is governed by its own quote, which details scope, number of pieces, rounds of revisions, timelines and payment terms.
- Unless the quote states otherwise, two rounds of revisionsare included. Additional changes or changes in scope are quoted separately.
- Usage rights for the pieces (media, territory and duration) are those stated in the quote. The photographer may show the finished work in their portfolio, unless there is a confidentiality agreement.
- Music, typefaces and stock footage licensed from third parties are subject to the terms of those licenses.
8. Liability
Work is done with professional equipment, dual memory cards and backups. If, despite these precautions, material is lost due to a technical failure beyond the photographer's control, their liability is limited to refunding the amount paid for the affected part of the service. The photographer is not responsible for circumstances at the event beyond their control, such as delays, schedule changes, venue lighting conditions or restrictions imposed by the venue.
9. Governing law
These terms are governed by the laws of the Argentine Republic, including Consumer Protection Law 24.240 where applicable. Any disagreement will first be resolved in good faith. If that is not possible, the ordinary courts of the Autonomous City of Buenos Aires will have jurisdiction, without prejudice to the rights the law grants consumers.
Privacy policy
This policy explains what personal information I receive through this site and my contact channels, and how I handle it, in accordance with Argentina's Personal Data Protection Law 25.326.
1. What data I receive
- What you send me. The “Check your date” form doesn't store anything on this site. If you tap “Send inquiry”, the details you entered (names, email, date, venue, number of guests, package and message) reach me by email at [email protected] through the Web3Forms service. If you choose “Send via WhatsApp”, WhatsApp opens with the message ready and it only reaches me if you decide to send it.
- What's needed for the service. If you hire me: name, ID or tax number, address and contact details for the contract and invoicing, and the event schedule.
- This site does not use analytics or advertising tools and does not create visitor profiles.
2. How I use it
- To answer inquiries, send quotes and coordinate the service.
- To draw up the contract and invoices, and to meet legal and tax obligations.
- I don't sell, rent or hand over your data to third parties. It is only shared when essential to provide the service (for example, with a second photographer on the team) or when required by law.
- I keep the data for as long as we work together and for as long as tax regulations require. After that it is deleted.
3. Third-party services
To work, the site loads some resources from other companies, which may receive technical data about your visit, such as your IP address and browser, under their own policies:
- Google Fonts, for the typefaces.
- Web3Forms (web3forms.com), which forwards the form inquiries to my email.
- Cloudflare, which hosts the site and manages the [email protected] email address.
- WhatsApp, Instagram and the email service you use, if you contact me through them.
4. Cookies and storage
The site does not use tracking or advertising cookies. It only stores two technical items in your browser: a flag so the loading animation doesn't repeat during your visit (sessionStorage, cleared when you close the tab) and your answer to the cookie notice (localStorage), so it isn't shown again. You can delete them whenever you like from your browser settings. The third-party services mentioned may use their own cookies.
5. Your photos
The images from your wedding or project are kept in private backups and shared only with you through private galleries. Those that appear on this site or on my social media are published with the consent of the people pictured. If you appear in one and want it removed, write to me and I'll take it down promptly.
6. Your rights
You can ask me at any time to access, correct, update or delete your personal data by writing to [email protected]. I'll reply within the time limits set by Law 25.326: 10 calendar days for access and 5 business days for correction or deletion.
The Agency for Access to Public Information, as the supervisory body for Law No. 25.326, has the authority to handle complaints and claims filed by anyone whose rights are affected by non-compliance with personal data protection regulations.
